1. Agreement to terms
These Terms of Service ("Terms") govern your access to and use of the Nomia Storage website, applications, APIs, and other products and services (collectively, the "Service") provided by Nomia Storage, Inc. ("Company," "we," "us," or "our").
By accessing or using the Service, you agree that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not access or use the Service.
2. Account registration
To use most features of the Service you must create an account. You must provide accurate, current, and complete information during registration and keep your account information updated. You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account.
You may not share your login credentials with any third party. You must notify us immediately at security@nomiastorage.com of any unauthorized use of your account.
You must be at least 16 years old to create an account. By using the Service you represent that you meet this requirement.
3. Use of the service
You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Upload, store, or transmit content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
- Use the Service to distribute malware, spyware, or other malicious code
- Attempt to gain unauthorized access to any portion of the Service or its related systems or networks
- Interfere with or disrupt the integrity or performance of the Service
- Scrape, crawl, or systematically extract data from the Service without our express written permission
- Use the Service to send unsolicited communications (spam)
- Violate any applicable laws or regulations
We reserve the right to suspend or terminate accounts that violate these terms, with or without notice, at our sole discretion.
4. Payment and billing
Paid plans are billed in advance on a monthly or annual basis. Prices are displayed in US dollars and exclude applicable taxes. By providing a payment method, you authorize us to charge all fees for your selected plan.
Annual plans are non-refundable except as required by law. Monthly plans may be cancelled at any time and take effect at the end of the current billing period, with no prorated refund for the remainder of that period.
If your payment fails we will notify you and may suspend access to the Service after a 7-day grace period. We reserve the right to modify pricing with 30 days written notice.
5. Your content
You retain all ownership rights to files and data you upload to the Service ("Your Content"). By uploading content, you grant Nomia Storage a limited, worldwide, royalty-free license to host, store, transmit, and display Your Content solely as necessary to provide and improve the Service.
You are solely responsible for the legality, reliability, accuracy, and appropriateness of Your Content. We do not routinely inspect user content, but we may remove content that we believe violates these Terms or applicable law.
6. Intellectual property
The Service and its original content (excluding Your Content), features, and functionality are and will remain the exclusive property of Nomia Storage, Inc. and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
7. Termination
We may suspend or terminate your account and access to the Service at any time for any reason, including if we reasonably believe you have violated these Terms. Upon termination you will have 30 days to export Your Content; after that period we may permanently delete it.
You may terminate your account at any time by visiting account settings or by emailing support@nomiastorage.com.
8. Limitation of liability
To the fullest extent permitted by law, in no event will Nomia Storage, Inc. or its affiliates, officers, directors, employees, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, or goodwill, arising out of or in connection with your use of, or inability to use, the Service.
Our total aggregate liability to you for any claim arising from or related to these Terms or the Service will not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) US $100.
9. Indemnification
You agree to indemnify, defend, and hold harmless Nomia Storage, Inc. and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.
10. Governing law
These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts located in San Francisco County, California.
11. Changes to terms
We may modify these Terms at any time. We will provide notice of material changes by email to the address associated with your account or by posting a notice on the Service. Your continued use of the Service after any modification constitutes your acceptance of the updated Terms.
